En leur temps, l’élaboration jurisprudentielle d’un droit communautaire des droits fondamentaux et la proclamation de la Charte des droits fondamentaux de l’Union n’ont pas manqué de poser la question d’une complémentarité et/ou d’une concurrence avec le système de la Convention européenne des droits de l’homme. Mais les termes du débat semblent désormais renouvelés depuis que l’entrée en vigueur du traité de Lisbonne a fait sortir la Charte de la catégorie des textes déclaratoires et engagé l’Union à adhérer à la Convention. La place et le poids de ces deux instruments s’en voyant modifiés, la période invite à repenser les relations entre les deux systèmes de garantie des droits de l’homme dans l’espace européen. Aussi l’ouvrage veut-il davantage s’intéresser à la théorie de l’équivalence des protections, à la fois comme élément de cohérence matérielle (dans le contenu des garanties offertes par la Charte et la Convention) et comme instrument d’articulation fonctionnelle (entre les contrôles respectivement assurés par la Cour de justice de l’Union européenne et par la Cour européenne des droits de l’homme), en intégrant une réflexion sur ce que pourrait ou devrait impliquer à cet égard l’adhésion en termes d’ajustement de leurs compétences. En prise sur les développements les plus récents, l’ouvrage se propose ainsi de jeter un nouveau regard sur l’avenir de la protection juridictionnelle des droits fondamentaux en Europe. Il intéressera les praticiens, confrontés aux problèmes de la coexistence et de l’articulation entre droit de l’Union et droit de la Convention, les professeurs, les chercheurs et les étudiants du troisième cycle.

The year 2000's most significant international event was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.

This "Liber Amicorum" is published at the occasion of Judge Lucius Caflisch's retirement from a distinguished teaching career at the Graduate Institute of International Studies of Geneva, where he served as Professor of International Law for more than three decades, and where he has also held the position of Director. The existence of interactions between different but overlapping legal systems has always presented challenges to black letter law. This is particularly true of the relationship between international law and domestic law and the relationship between federal law and the laws of individual federation members. Moreover some organisations have created their own supranational constitutional systems: the United Nations Charter is the best known, and is often referred to as the 'World Constitution', but the European Court of Justice in Luxembourg views the European Treaties as a 'Constitutional Charter' for Europe, while the European Court of Human Rights has defined the European Convention on Human Rights as a constitutional instrument of 'European public order'. It is in the dynamic relationship between domestic constitutional laws, EU law, the ECHR and the UN Charter that the most persistent difficulties arise. In this context 'interordinal instability' not only provokes strong academic interest, but also affects what has been called 'governance' or 'global government' and undermines both legal certainty and individual fundamental rights. Different solutions - constitutionalist and pluralist - have been explored, but none of them has received global acceptance. In this book Luis Gordillo analyses the interordinal instabilities which arise at the European level, focusing on three main strands of case law and their implications: Solange, Bosphorus and Kadi. To solve the difficulties caused by this instability Gordillo proposes a form of soft constitutionalism, which he calls 'interordinal constitutionalism', as a means to bring order and stability to global legal governance. The original Spanish thesis on which this book is based was awarded the Nicolás Pérez Serrano Prize by the Centro de Estudios Políticos y Constitucionales, for the best dissertation in constitutional law 2009-2010.

Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles – written and unwritten – that represent the common heritage of the constitutions of the Member States.
